    Void marriage

    The Void marriage is a marriage that is void and invalid from the beginning. There are certain forms of marriage which are null and void despite the solemnization of the same. Such marriage is unlawful and requires no formality to terminate.

    Marriage is void under following conditions if:

    • The parties are not respectively Male and Female.
    • The parties are within the forbidden close family.
    • A male person marries under eighteen (18) years of age or a female who is between 16 & 18 years of age marries without a special marriage license.
    • At the time of marriage either party was already lawfully married and the former spouse still living at the time of the marriage and such former marriage was then in force.

    Marriage is void under following status:-

    • Neither party has a partner living at the time of the marriage.
    • The parties are not within the degrees of prohibited relationship, unless the custom or usage governing each of them permits of a marriage between the two.
    • There could be other reasons as well depending upon the situation and case.

    Time duration for obtaining divorce varies from case to case & place to place. In general, contested divorce proceedings take approximately 18 to 24 months.

    Mutual Consent Divorce varies from 4 weeks to 7 months and more.

    In general, procedure for obtaining Divorce in all forms of law (based on religion) is same with only bit of variation.
